1. Introduction
Welcome to SteadyStoneCenter ("we," "us," or "our"). These Terms & Conditions ("Terms") are a contract between you and us and govern your use of our yacht charter services and the website found at steadystonecenter.sbs, all operated by SteadyStoneCenter.
Your reservation of a charter or use of our Service implies that you accept these Terms. Should you not agree with any part of the terms, you should refrain from using the Service.
2. Service Overview
SteadyStoneCenter offers high-quality yacht charter services, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate getaways
- Exclusive gatherings
- Extended charters
Services are dependent on availability and the weather. We retain the right to alter or cancel services at our discretion.
3. Booking and Reservations
3.1 Booking Procedure
When making a charter reservation, you must:
- Be at least 18 years old
- Provide valid and comprehensive information
- Remit the deposit as stated in the booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed upon our receipt of your payment and our issue of a written confirmation. We hold the authority to deny service at our discretion.
3.3 Availability
Charter schedules are subject to the accessibility of vessels and favorable weather. We shall endeavor to accommodate your requested schedule as best possible.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and include all relevant taxes unless otherwise stated. Rates are subject to modification at any time without notice.
4.2 Schedule of Payments
- Deposit: 50% of the overall charter cost due at the time of reservation
- Final payment: Due 48 hours prior to the commencement of the charter
- Additional fees (if relevant): To be paid after the charter concludes
4.3 Methods of Payment
We accept major credit cards, electronic bank transfers, and certified bank drafts. We ensure secure, encrypted processing of payments.
5. Cancellation and Reimbursement Protocol
5.1 Client Withdrawal
- If canceled more than 72 hours before sailing: Complete reimbursement minus transaction costs
- Cancellations between 24 to 72 hours before sailing: Refund of 50%
- Cancellations under 24 hours before sailing: No reimbursement
5.2 Cancellation Due to Weather
In case the captain deems weather conditions unsafe, we will propose either:
- Rescheduling of your charter to an alternative suitable date at no extra charge
- Issuing a full refund if rescheduling isn't feasible
5.3 Mechanical Difficulties
If there are mechanical issues with the designated vessel, we will aim to arrange a comparable substitute. If this is not possible, we will provide a full refund.
6. Safety and Behaviour
6.1 Safety Standards
All people aboard must:
- Comply with all directives issued by the crew
- Use provided safety gear as required
- Inform us of any health conditions that could affect their wellbeing
- Stay within designated areas on the yacht
6.2 Forbidden Articles
The items enumerated below are not allowed on the yacht:
- Containers made of glass
- Illegal substances
- Guns or other armaments
- Pets (unless explicitly permitted beforehand)
6.3 Behavioural Expectations
Patrons are expected to act with decorum. Should a passenger's conduct become a safety hazard or impede the enjoyment of other guests, we may curtail the voyage early and no refund will be granted.
7. Liability and Coverage
7.1 Our Responsibility
Our accountability is restricted to the sum paid for your charter, and we are not answerable for:
- Injuries caused by passenger heedlessness
- The theft or damage of personal belongings
- Indirect verdict or exemplary damages
- Delays originating from weather or situations outside of our control
7.2 Indemnity Provisions
We have comprehensive maritime insurance that covers our fleet and business activities. Visitors are accountable for arranging their travel and personal indemnity.
7.3 Risk Acknowledgement
You recognize that nautical activities carry inherent hazards, and by participating in our charter services, you accept full liability for your personal safety and welfare.
8. Alterations and Itinerary Adjustments
We have the right to adjust itineraries, courses, or timetables due to weather, safety, or operational needs. We commit to offering comparable alternatives when changes are necessitated.
9. Act of God
We shall not be liable for interruptions, deferrals, or changes caused by events beyond human control, inclusive of but not constrained to:
- Extremely adverse weather
- Cataclysmic events
- Legal restrictions
- Harbor shutdowns
- Vehicular malfunctions
10. Privacy and Information Security
We handle your private data in compliance with our Privacy Policy, and by utilizing our services, you consent to our collection and use of your data in the manner outlined in our Privacy Policy.
11. Intellectual Property Rights
The content on our website – texts, drawings, emblems, and images – is protected under copyright and trademark laws. No reproduction, dissemination, or creation of derivative works is authorized without our written consent.
12. Applicable Law
These terms are regulated by laws valid in Spain, and any disputes shall be settled in courts located in Barcelona, Spain.
13. Amending Terms
We reserve the jurisdiction to alter these Terms when necessary. Any changes will be published on our site with a new revision date. The continued utilization of our services signifies your agreement to the modified terms.
